This Privacy Policy outlines the manner in which Capri Global Ventures Private Limited, incorporated under the provisions of The Companies Act, 1956, having its registered office at 1B, First Floor, Court Chamber, 35, Sir Vithaldas Thackersey Marg, New Marine Lines, Mumbai-400020 (hereinafter referred to as "CGVPL") collects, receives, stores, uses, processes, transfers, discloses and safeguards Personal Data in connection with the Playdate skincare and cosmetic brand, including the Playdate website, digital platforms and related services (collectively called "Platform").

Playdate is a consumer brand operated by CGVPL. For the purposes of applicable data protection laws, including the Digital Personal Data Protection Act, 2023 ("DPDP Act"), CGVPL is the Data Fiduciary responsible for processing your Personal Data.

Throughout this document, "we", "us", "our", "ours", "Playdate" refer to CGVPL. Wherever we have said "you" or "your" or "Customer", this means YOU.

This Privacy Policy serves as a notice to Data Principals and explains the categories of Personal Data we collect, the purposes for which we process it, how it is stored, retained, disclosed and protected, and the rights and choices available to you under applicable law.

The Platform is intended for users in India and Playdate does not currently offer products or services for purchase outside India. By accessing or using the Platform, you acknowledge this Privacy Policy. Where consent is required under applicable law, we will obtain such consent in the manner prescribed by applicable law.

Who is covered by the Privacy Policy?

This Policy applies to all users, website visitors, customers, prospective customers, business partners, vendors, job applicants, service providers and other persons who access or use the Playdate Website, Playdate digital platforms, Playdate products or services offered.

If you are below 18 years of age, then you are expected to use the Website under the supervision and guidance of your natural guardian parents or legal guardians.

This Privacy Policy describes the categories of information collected by Playdate, the manner of collection, purpose of use, storage, retention, disclosure and protection of such information, and the rights and responsibilities of users in relation thereto. The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

"Processing" means any operation performed on personal data, including collection, recording, storage, use, sharing, disclosure, retention, erasure, or deletion.

"Data Fiduciary" means the entity that determines the purpose and means of processing personal data. For the purpose of this privacy policy, the Data Fiduciary responsible for processing your personal data is CGVPL, registered office as mentioned in this document above.

"Data Processor" means any person or entity that processes personal data on behalf of a Data Fiduciary.

"Consent" means a freely given, specific, informed, unconditional, and unambiguous indication of the Data Principal's agreement to the processing of their personal data for a specified purpose.

"DPDPA" means the Digital Personal Data Protection Act, 2023, together with rules, regulations, and notifications issued thereunder, as applicable.

1) Types of Data Collected — Personal Data

Personally identifiable information may include name, billing and shipping address, email address, contact details, order details, purchase history, communication preferences, information provided through contact forms, customer service communications and such other information as may be required to provide our products and services.

Where you purchase products through the Website, we may collect information necessary to process and fulfil your order, including shipping details, billing information, payment transaction details, product information and information relating to returns, refunds or cancellations.

4) Information Collected While Using the Playdate Platform

If a User accesses the Playdate Platform, Playdate may require certain device/website permissions to provide the User certain functionalities within the Playdate Platform in accordance with prevailing law/regulation. This further allows the User a seamless experience on the Playdate website/software/application.

Users need to give permission of device access to the following, as applicable:

a. User has sole right and discretion to provide or withdraw permissions of access by managing device settings, subject to the functionality of the Website. User can raise a request to erase app data and within a specific timeline it will be erased by CGVPL.

b. Personal Data collected through the Website will be used only for the purposes described in this Privacy Policy or for other purposes permitted under applicable law.

c. We take reasonable technical and organisational measures to protect Personal Data against unauthorised access, disclosure, alteration, loss or destruction.

d. Where Personal Data is no longer required for the purposes for which it was collected, we will make reasonable efforts to securely delete or anonymise such information, subject to applicable legal, regulatory and business requirements.

e. We do not knowingly collect biometric data through the Website unless permitted and required under applicable law and with appropriate safeguards.

E] Use of Your Personal Data

Personal Data collected by Playdate may be used for any such purposes as may be permissible under applicable law, including: website registration and account management; order processing and fulfilment; payment processing; product delivery; customer service and grievance redressal; returns, refunds and cancellations; marketing and promotional communications; product launches and brand communications; marketing analysis; analytics and product improvement; Website operation and security; and legal and regulatory compliance. The ground for processing under the DPDPA is generally consent and/or certain legitimate uses, where applicable, or legal obligation where relevant.

The above purposes and categories are indicative and may be updated from time to time to reflect changes in our products, services, Website functionality or applicable law.

F] Security of Your Personal Data

We implement reasonable technical and organizational measures to protect your personal data against unauthorized access, disclosure, alteration, loss, or destruction.

Playdate ensures that access to User data is sufficiently restricted using access controls and industry standard encryption algorithms. Playdate has in place an incident management system and incident response practices. If retaining Customer information is no longer necessary, we make every effort to securely destroy or deal with it as per applicable laws, regulations and our internal retention practices.

i) Handling by Service Provider

Sharing with third parties is kept to the minimum necessary for providing our products and services and operating the Website.

H] Responsibility of User

User acknowledges the following:

a. Playdate and its employees/assignees will not ask the User to disclose passwords, OTPs, complete payment card details or other confidential information through unsolicited calls, messages or emails. User is solely responsible for exercising proper due diligence before disclosing Personal Data or making payments.

b. Playdate will not be liable/responsible for any breach of privacy or security arising directly from User's negligence, including sharing passwords, OTPs or account credentials with third parties.

c. User shall only use the official Website, links and applications of Playdate for purchasing products or providing Personal Data.

d. User shall exercise reasonable caution to ensure that Personal Data, passwords, payment information, account details and other confidential information are not shared with unauthorised persons.

e. User should always check if "https" appears in the Website address bar before providing Personal Data or making an online transaction.

f. User should avoid using third-party browser extensions, plug-ins or add-ons that may increase the risk of tracking or unauthorised access to Personal Data.

We have no control over and assume no responsibility for the content, privacy policies or practices of third-party sites or services.

I] Disclosure of Your Personal Data

If CGVPL or the Playdate business is involved in a merger, acquisition, restructuring, sale of assets, investment transaction or other business transaction, Your Personal Data may be transferred as part of such transaction, subject to applicable law and appropriate safeguards.

We will not process children's Personal Data in a manner prohibited under applicable law, including tracking or behavioural monitoring of children or targeted advertising directed at children, except as permitted by law.

Where a child's Personal Data is provided in connection with an order, delivery, customer service request or other permitted purpose, we will process such Personal Data only for the relevant purpose and in accordance with applicable law.

M] Cross-Border Data Transfer

Playdate processes and stores personal data within India. Personal data is not transferred outside India, except where such transfer is permitted under applicable laws and is carried out in compliance with the DPDPA and any rules or notifications issued thereunder.

We may update this Policy to reflect changes in law, regulatory requirements, or our processing practices.
